“Foreigners are losing their property in Phuket.” A headline like that can make a buyer pause or an existing owner worry. The useful question is more precise: what rights did the buyer acquire, and how were they registered?

Investigations into nominee arrangements are real. They do not establish that every foreign-owned condo or foreign buyer’s villa is being seized. A lawful acquisition and an arrangement designed to bypass land ownership restrictions need to be assessed separately.

What actually happened

The Nation reported on 21 June 2026, citing a government spokesperson, that authorities were investigating suspected nominee networks in Phuket, Phang Nga and Krabi. The operation concerned companies and land linked to suspected unlawful foreign control. An investigation, search or arrest is not a final judgment or proof that every property involved has been confiscated.

A Thai company is not automatically an illegal arrangement

A Thai company may lawfully own land if it meets the applicable legal requirements. Incorporation alone does not establish that a particular foreign buyer’s transaction is lawful.

The concern is a structure in which Thai participants merely lend their names while land is effectively held for a foreigner to circumvent the law. These participants are known as nominees. Share percentages on paper do not replace an examination of genuine participation, funding and the transaction itself.

Official BOI guidance on land and property ownership

It is unfair to assume that every buyer understood the risks. Someone may have relied on an intermediary or been told that everyone uses the same arrangement. We cannot know what an individual buyer was told. Widespread use and a confident sales pitch are not evidence of legality.

Separate the land, the building and the condominium unit

Foreign individuals generally cannot own Thai land outright. Specific statutory exceptions have conditions and approvals; an ordinary villa purchase does not automatically qualify. With a house, the rights over the building and the underlying plot must be examined separately.

An unlawful holding can lead to a requirement to dispose of the land and other legal consequences. The word “seizure” should not replace an explanation of the legal grounds, procedure and outcome in the individual case.

Legal explanation of foreign land ownership restrictions

Freehold and leasehold give different rights

Freehold means ownership. A foreign buyer may own an eligible unit in a registered condominium within the foreign quota, subject to buyer eligibility and documentation requirements. Calling a villa “freehold” does not establish that a foreign individual can own its land.

Leasehold means a time-limited lease, not land ownership. An ordinary property lease is capped at 30 years. A term longer than three years must be in writing and registered to be enforceable beyond the first three years. “30 + 30 + 30” is not an already registered 90-year right.

A lease label does not cure an unlawful underlying arrangement. Check the lessor’s title and authority, registration and the complete agreement package. Renewal, assignment and inheritance terms need their own review.

Does a lawful purchase mean there is nothing to worry about?

News about nominee investigations does not itself establish a problem with your transaction. Properly acquired rights give you a legal basis for protection. Reviewing your documents is more useful than trying to predict the outcome of an unrelated case from a headline.

However, “nobody can ever take it away” would be an irresponsible promise. Title disputes, encumbrances, contract breaches and registration problems can arise independently of nominee arrangements. A good adviser identifies risks and explains consequences before payment; they cannot guarantee that no dispute will ever occur.

What to check before paying

1. The asset or right being acquired. Is it a condominium unit, building, company shares or a lease? What will actually be registered in your name?

2. Title and seller documents. Review boundaries, encumbrances, road access, the seller’s authority and construction documentation.

3. The ownership structure. Where a company is involved, have an independent Thai lawyer assess its participants, funding, obligations and actual purpose.

4. Contract and registration terms. Review payment dates, deposit refunds, termination, assignment, inheritance and renewal promises. Obtain written findings before transferring funds.

If you already hold property through a company, begin with an independent document review. Do not rush into shareholder changes or new agreements based on advice in a group chat.
